TERMS AND CONDITIONS

SCOPE OF APPLICATION

These Terms and Conditions apply to all orders placed in our ZAUNKÖNIG® online shop or via email—whether by private individuals or businesses.

Our offer is directed at both consumers and business owners as defined by the German Civil Code (BGB).

With respect to business customers, the GTC also apply to future business relationships without us having to expressly refer to them again.

CONTRACTING PARTY, CONCLUSION OF CONTRACT, CORRECTION OPTIONS

The purchase contract is concluded with ZAUNKÖNIG®.

The presentation of our products in the online shop does not constitute a binding offer—rather, it is an invitation for you to explore our products and place an order if interested.

You can initially add our products to your shopping cart without obligation and review and correct your entries at any time during the ordering process. The correction functions provided for this purpose are available directly at checkout.

By clicking the “Buy Now” button, you are submitting a binding offer for the products contained in your shopping cart.

Immediately after we receive your order, you will automatically receive an email from us confirming receipt of your order. This email does not yet constitute acceptance of the contract.

The contract is only concluded when we either accept your order via a separate order confirmation by email or the payment is successfully processed—whichever occurs first.

Exactly when the payment is processed depends on the payment method you have selected (see “Payment Methods” for more details).

For business customers (entrepreneurs):

Orders can also be placed via email. In these cases, the contract is only concluded upon our express declaration of acceptance or the execution of the delivery. The earlier event is decisive.

CONTRACT LANGUAGE, STORAGE OF CONTRACT TEXT

The language available for the conclusion of the contract is German.

We do not permanently store the complete contract text, but it is included in the order confirmation that you will receive via email after completing your order.

If you create a customer account with us, you can view your orders there later. However, you cannot access a complete contract text, including the current version of the Terms and Conditions, the cancellation policy, etc., in your customer account.

We therefore recommend that you keep the order confirmation in a safe place.

For business customers (entrepreneurs):

In these cases, we will send you all contract-related information (e.g., product details, prices, Terms and Conditions) separately via email. Here, too, we recommend that you keep the order and contract documents.

PAYMENT

PRICES

The prices for our ZAUNKÖNIG® products include applicable sales tax and are displayed in the shop as soon as you select a product.

For business customers (B2B), the price may be shown as net or tax-free depending on the delivery country and tax registration. The final calculation is made at checkout based on the data entered.

Shipping costs are added depending on the product and delivery address—they are listed separately and transparently added to the total amount at checkout. You can find an overview of possible shipping costs under the “Shipping” menu item.

Before you complete your order, you will see the full total price—including all taxes and shipping costs—in the final step at checkout.

The full invoice amount is due upon completion of the order, regardless of the payment method you choose.

As soon as we receive your order, you will receive an automatic order confirmation from us via email—with all important details regarding the order, the invoice amount, and the total amount due.

Payment Methods

In our shop, you can choose from the following payment methods:

Prepayment

If you choose prepayment, please transfer the total amount, citing the invoice number you receive with our order confirmation via email.

As soon as we receive your payment, we will process your order.

Please note: For orders placed with the prepayment method, if payment is not received within 14 days, your order will be automatically canceled and deleted.

PayPal

With PayPal, you can pay online conveniently and securely. To do so, you need an active PayPal account. Simply log in with your credentials and confirm the payment directly during the checkout process. The payment will be processed immediately after you submit your order.

Depending on your PayPal profile, PayPal may offer you additional payment options such as “Pay Later” or “Installment Payments.” These options come directly from PayPal—we have no influence over them. You can find more information about this in your PayPal account.

Shopify Payments (e.g., Shop Pay, Visa, Mastercard, Maestro, Apple Pay, Google Pay, Klarna Invoice)

Payments via Shop Pay, credit card, Apple Pay, Google Pay, or Klarna are processed through our payment service provider, Shopify Payments.

The payment is also triggered immediately upon submission of the order.

Please note: For certain payment methods (e.g., Klarna), the terms of use and privacy policies of the respective providers also apply. These will be displayed to you during the payment process.

For payments with Klarna, the terms and conditions of Klarna Bank AB (publ) apply—you can obtain further information directly from Klarna.

For business customers (e.g., retailers), different payment terms may apply in individual cases—such as for orders placed via email or on account. Such agreements are made on a case-by-case basis.

Regardless of the chosen payment method, the following applies: The goods remain our property until full payment has been received.

SHIPPING, DELIVERY TERMS, AND SHIPPING COSTS

We currently ship to Germany, Austria, and Switzerland.

Depending on the product type, shipping is handled by a parcel service (e.g., DHL GoGreen) or a freight carrier (e.g., GO! Express & Logistics). We select the shipping provider.

The applicable delivery times are listed on the individual product pages. They apply from the time of receipt of payment or from the order confirmation, whichever occurs later.

Shipping costs within Germany are a flat rate of €7.50 gross. For certain products—such as the ZAUNKÖNIG® Learning Tower (3-in-1) — we cover the shipping costs within Germany.

For commercial orders (e.g., by retailers with a valid VAT ID), shipping costs may be shown net.

For deliveries to non-EU countries (particularly Switzerland), additional customs duties, taxes, or fees may apply, which are your responsibility. We do not cover these costs.

The exact shipping costs to other European countries will be displayed directly to you during the ordering process.

Partial deliveries are permitted provided they are reasonable for you. No additional shipping costs will be incurred.

TRANSFER OF RISK AND TRANSPORT DAMAGE

When shipping to consumers, the risk of accidental loss and accidental deterioration of the goods is transferred to you only upon delivery of the goods to the customer. For commercial orders (e.g., from companies or institutions), the risk is transferred to you upon handover to the shipping provider (§ 447 BGB).

Please report any obvious transport damage immediately to the delivery person and notify us without delay. Failure to file a complaint has no impact on your legal claims, but it helps us in asserting claims against the shipping provider.

RIGHT OF WITHDRAWAL AND RETURNS

Consumers have the right to withdraw from the contract within 14 days without giving a reason.

The right of withdrawal applies exclusively to consumers as defined in § 13 BGB. Entrepreneurs (e.g., merchants) are not entitled to this right.

Refunds will be issued within 14 days of receiving your cancellation notice, but no sooner than once we have received the returned goods or you have provided proof of shipment. Refunds will be processed via the same payment method used for the original transaction.

Products that have been manufactured to customer specifications or clearly tailored to personal needs (e.g., personalized items) are excluded from the right of withdrawal.

Returns must be made in the original packaging and must be unused. Unpaid shipments will not be accepted. Returns must be sufficiently stamped and sent to the following address:

WARRANTY

Liability for Defects

The statutory warranty rights apply to all products in our shop.

This means: If delivered items happen to have defects, you can of course contact us.

Within the warranty periods, we will ensure that defective products are either repaired, replaced, or—if necessary—refunded. This is subject to the condition that the defect was not caused by improper or unintended use.

Please report obvious defects as soon as possible after receiving the delivery. This helps us find a good solution more quickly. Your statutory rights remain unaffected, of course.

Note: This warranty should not be confused with a manufacturer’s warranty. We do not currently offer such a warranty—but you can rely on the statutory provisions.

For business customers (B2B):

The warranty period is one year from receipt of the goods. In addition, the statutory provision regarding the duty to give notice of defects (§ 377 HGB) applies—i.e., recognizable defects must be reported immediately upon receipt of the goods.

Warranties and Customer Service

We do not currently offer a warranty that extends beyond the statutory warranty. We also do not have a separate customer service department—but you can reach us at any time via email at hallo@znkg.de if you have questions about a product or a defect.

ALTERNATIVE DISPUTE RESOLUTION PURSUANT TO ART. 14(1) ODR REGULATION AND § 36 VSBG

We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board and, unfortunately, cannot offer you participation in such proceedings.

The website www.znkg.de is subject to the copyright of ZAUNKÖNIG® in Halle (Saale).

The entire content of the website, including text, graphics, photos, images, illustrations, and software (hereinafter referred to as “Content”), is the property of ZAUNKÖNIG®, represented by Ursula Schreck. This includes all elements of the website, including the general design and content.

The reproduction, editing, translation, storage, or processing of the content—in particular the use of image and text material, in whole or in part—on platforms such as eBay is not permitted.

FINAL PROVISIONS

The laws of the Federal Republic of Germany apply. The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

Should any individual provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.

If you are a consumer and have your habitual residence in another EU country, the mandatory consumer protection provisions of that country shall also apply.
